Scott, over the years I've read several accounts of pilots handing over their
"license" (sometimes to civilian LEO) and having difficulty getting it back.
Of course, it was always just one side we were hearing from (and not sworn
testimony at that!).

OTOH, I've met a couple of Inspectors who I wouldn't doubt might bluff their
way through such a scenario. As we've seen in recent news accounts, when
there is a legal confrontation and one party draws a line in the sand,
sometimes affairs can get out of hand quickly and irrationally going far
afield from the original intent.

I worry more about the small town deputy who does not know he can't take the license. The FAA has a procedure to follow that includes written notice. In the three times I have been ramped, I never feared handing the certificate to inspector.

If a certificate is illegally confiscated, can't you just explain to the FAA that it was stolen (including by whom, so they don't think you're trying to put something over on them), and get them to issue you a new one, including an emailed authorization to fly while waiting for the new certificate?

Maybe so, but what good does it do you in a small town in Iowa where Deputy Dog keeps your license because you landed after the FBO closed Saturday night... and now that you have refueled, you can't legally leave without it.

Even if the FAA responds to your email, do you really think you could get going the very next day? Sunday?

I am not paranoid, but I could see it happening.

Yeah, especially on a weekend away from home base, it would be a real pain.
