Is there a way to search or get the text of a Certificate of Waiver or Authorization? Aerial Banners is creating a dust-up in the media claiming that their FAA COA trumps state law against advertising. But the last time this happened, it appears the COA included requirements to obey state law. Just wondering if similar language is in this one.

How about this ruling from 2006?

I don't think anything has changed and so there's no preemption. They can fly, they can probably tow a banner. But there's no Federal preemption that says they can have advertising on the banner. (And the court also found there was no first amendment right.)

But the specific reason I'm asking - from the link above:

The Center’s certificate contains explicated language stating that it “does not constitute a waiver of any State law or local ordinance.”




I wanted to see if the same language was in this operator's certificate. I would have thought those things would be public, but I'm not finding any.
